The US DoJ Antitrust Division’s initiative consists of new guidance issued in July 2019 on the evaluation of corporate compliance programs in criminal antitrust investigations such as price-fixing, bid rigging, and market allocation. It is intended to assist the Division prosecutors in their evaluation of antitrust compliance programs at the charging and sentencing phases of an investigation. In August 2020, the DoJ announced the creation of the Office of Decree Enforcement and Compliance. One of this Office’s function is to advise the Antitrust Division’s criminal sections when parties seek credit at the charging stage for their corporate compliance programs and to ensure the effective implementation of and compliance with judgments.
